Florida Ancillary Probate
An Ancillary Probate proceeding also known as an Ancillary Administration is a probate procedure conducted in a different state from the one the deceased person resided in at the time of death in order to transfer good title to real estate in another state.
When a resident of a state other than Florida dies owning real estate in Florida a Florida Ancillary Probate case is needed to pass the Florida real estate to the beneficiaries of the will or the heirs if it is an intestate estate. If there was a probate needed in the home state of the decedent for any tangible personal property or real estate within the home state an exemplified transcript of the probate proceedings from the domicilary jurisdiction are submitted to the Ancillary state.
For example if a guy dies as a resident of New York owning a home in Manhattan in his sole name probate proceedings would be handled in New York County Probate Court. Documents from that New York Probate case would be used in an ancillary probate case for another jurisdiction. Florida has frequent ancillary probate cases with all the snow birds that come to Florida for the winter. A frequent example would be the New York County resident owning a home in Boca Raton in their sole name. An Ancillary Probate case would be filed in Palm Beach County Florida Probate court to help transfer the real estate to the Florida beneficiaries or Florida heirs.
Other than requiring the transcript of the proceedings of the state of domicile a Florida Ancillary probate is otherwise the same as a regular Florida probate would be. A Florida Ancillary Probate may be handled as a summary probate or a Formal probate depending on the facts of the case. For a Formal probate a Personal Representative will need to be appointed for the Ancillary Probate and in most cases the Personal Representative of a Florida probate needs to be a close relative as defined by florida probate law or a resident of Florida.
